The Fundamental Danger of Restricting Local Authority to Build Broadband Networks

Several days at the National Conference for Media Reform in Boston gave me time to reflect on the importance of protecting local authority to build, own, and operate their own networks connecting people and businesses to the Internet. Multiple presentations focused on the importance of and strategies for ensuring access to the Internet is not controlled by a few companies -- and most of these strategies are focused at federal government agencies and Congress.

While we support these efforts, the Institute for Local Self-Reliance is not a DC-centric organization. We try to help folks in DC learn about what is happening outside the beltway, but our passion and work focuses directly on helping local communities invest in themselves and preserve their self-determination. 

Access to the Internet will likely be the key infrastructure investment that determines how well communities fare in the coming years. Unfortunately, they have very little control over how those investments are made when the networks are owned by private, absentee companies. Efforts like Universal Service Fund reform, fixing the FCC, re-writing the telecom act, and ensuring network neutrality depend on overcoming incredibly powerful (due to their scale and lobbying power) interests in Washington, DC. But local communities have very little power outside their borders... with some in state capitals and practically none in the nation's capital.

AT&T Pushes to Prevent Potential Broadband Competition in South Carolina

In South Carolina (the state TWC Forgot), AT&T is pushing harsher restrictions on any publicly owned broadband system in an attempt to derail one or more broadband stimulus projects. South Carolina already greatly restricts community broadband networks, likely one of the reasons no incumbent there bothers to upgrade in a similar time frame as the rest of the country. This should be seen a significant overreach -- AT&T is trying to shut down County efforts to improve middle mile access -- whereas most preemption tends to heavily restrict community last-mile networks. This is a whole new world of anti-competitive policy to favor AT&T (not dissimilar from what AT&T wants to do in Wisconsin and Fairpoint did in Maine).
The bills would force Oconee County to follow guidelines as a broadband service provider that would likely cripple the county’s current three-year project to construct 245 miles of broadband cable, county administrator Scott Moulder said. ... Oconee County’s goal is to be a so-called “middle mile” provider, Moulder said, essentially providing a network that would allow private broadband providers to extend their service into areas they aren’t serving. In most cases, those are areas where the private providers have found it is not financially feasible to install their own infrastructure. AT&T, Moulder said, has been asked to be a partner in the project as a retailer, but the company’s current actions are a rebuff.
The Oconee project is meant to attract additional independent service providers to invest in projects, not the County itself. But that hardly matters to AT&T, which wants to preserve the present lack of competition in order to maximize their gains at the public expense. The Bill, S 483 is viewable here and contains the same old tired arguments claiming the public sector has all the advantages.

New from the Carolinas

  • Salisbury, a community in North Carolina building a city-owned full fiber-to-the-home network, has run into an unexpected difficulty: naming the new network.

    To put it simply, all the good names are taken. Mike Crowell, director of broadband services — he jokes that he is the director of BS — says the city can't find a name that it can both trademark and get a domain name for.

    The story has some entertaining suggestions - but the reason I wanted to note the article is because it ends with this:

    In coming weeks, the city will be purchasing and outfitting a marketing trailer, which it can send into neighborhoods and to community events to explain the new cable utility and get people excited about what's around the bend. The trailer will be plastered, of course, with the system's chosen name.

    This is a great marketing method - particularly if the trailer has computers showing what is possible with the new network in direct comparison to existing offers. Wilson's Greenlight Network also used this approach and reported that it was very successful.

  • South Carolina was unique in being the only state where the public controlled the spectrum available for WiMax and could have built a state-wide broadband network. Instead, they chose to sell it off to the private sector for a pittance.

  • Despite state-created barriers to publicly owned broadband networks in South Carolina, the town of Hartsville is studying the feasibility of a city-owned network. The new Mayor is supporting this initiative:

    Pennington spoke about a proposed broadband initiative he is pushing that would enable the city to create a fiber optic network and offer broadband services such as high speed internet, cable television and digital telephone service to city residents and businesses.
